This seminar will present a practical approach to handling motions to suppress evidence by offering an easy-to-use analytical model that works in practically every kind of police-citizen encounter and that can help practitioners quickly spot search and seizure issues. The seminar will focus on how to identify and resolve the legal and factual issues that are actually in dispute and will include an update on significant recent decisions that may reveal the course that the New Jersey courts have charted for the future of search and seizure jurisprudence. Beyond presenting the analytical template, the seminar will address a number of hot topics, including: What remains of the Automobile Exception after State v. Pena-Flores? When will telephonic warrants be available during unplanned roadside encounters? When can the Attenuated Taint (“Break in the Chain”) Doctrine save the State’s case? Can it really be true that consent has emerged as the most reliable exception to the warrant requirement? How long must police on a raid wait after “knocking and announcing,” and when can they use a “flash bang”? When can officers conduct a protective search for weapons based upon a “tip,” and how can prosecutors distinguish their cases from Florida v. J.L.

This seminar will focus on identifying the issues and legal principles that arise from the application of the Rules of Professional Conduct by government attorneys, particularly in the context of investigating and prosecuting a criminal matter. Among the issues to be addressed will be: What does R.P.C. 4.2 prohibit? How does an attorney evaluate whether a person should be deemed to be represented when they are part of an organization known to be represented? When is there a “matter” as defined in Rule 4.2? Are ex parte communications with represented persons ever authorized, particularly if the attorney believes that a crime may be ongoing?What are a prosecutor’s responsibilities when he/she receives information indicating that one or more defense counsel or counsel representing witnesses in a criminal matter may be conflicted? What are the standards that the courts apply to determine whether a conflict exist? What conflicts can be waived and what is the procedure for obtaining an effective waiver?

With the exception of the opening lecture, participants will perform faculty critique of a student performance in a simulated mock trial skills program setting. In each workshop, participants will be presented with a live student performance and at the end of the performance will be asked to provide a critique of that performance of the sort that would be given at an trial advocacy skills program.

Deposition Skills Program

This three-day deposition skills program focuses on enhancing the skills needed to effectively elicit information and obtain admissions through depositions. Participants will enhance their deposition skills through frequent opportunities to conduct deposition examinations and defend depositions in a simulated deposition setting, followed by faculty commentary and critique. Lectures on several topics relevant to effective depositions will supplement participant performances and faculty critique. The exercises will focus on witness preparation, dealing with preliminary matters, a technique for effectively eliciting complete information from witnesses, using exhibits, dealing with obstreperous opposing counsel, obtaining admissions and theory testing.

This seminar will focus on the effects of the United States Supreme Court's decision in Crawford v. Washington, 541 U.S. 36 (2004). Over 10,000 legal sources have cited this landmark decision, which defines the admissibility of testimonial hearsay under the Confrontation Clause. Those sources, including many New Jersey court decisions, discuss the meaning of "testimonial" and "non testimonial" hearsay, "unavailable" witnesses, and "supporting" or "foundational" documents. This seminar will focus on how courts have interpreted Crawford, and on issues yet to be resolved.
